If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 19 – SECURITY POLICY
Card Details
Here at Powerpac our Payment Service Provider is Sage Pay (formerly Protx) – the largest independent payment service provider (PSP) in the UK and Ireland.
Sage Pay provides a secure payment gateway (Level 1 PCI DSS), processing payments for thousands of online businesses, including ours. It is Sage Pay’s utmost priority to ensure that transaction data is handled in a safe and secure way.
Sage Pay uses a range secure methods such as fraud screening, I.P address blocking and 3D secure. Once on the Sage Pay systems, all sensitive data is secured using the same internationally recognised 256-bit encryption standards.
Sage Pay is PCI DSS (Payment Card Industry Data Security Standard) compliant to the highest level and maintains regular security audits. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable.
Sage Pay is an active member of the PCI Security Standards Council (PCI SSC) that defines card industry global regulation.
In addition, you know that your session is in a secure encrypted environment when you see https:// in the web address, and/or when you see the locked padlock symbol alongside the URL.
So when buying through our site, you can be sure that you are completely protected.
Personal Data
Your personal data is stored on our UK server in an encrypted format. This is governed in the UK by the Data Protection Act. We only use this data to process any orders that you make and to make it quicker and easier for you to make future orders from us. You can delete your information that we hold by logging onto your account and selecting “Close My Account”.
If you place your order on Ebay and use PayPal by logging into your own PayPal account then your payment information is entirely handled by them and not shared with Powerpac in any way.
If you place your order on Amazon then your payment information is entirely handled by them and not shared with Powerpac in any way.

SECTION 20 – RETURNS POLICY
We offer a 14 day money back guarantee on all orders received through our website.
You can send any item, that your ordered from us, back to us for a refund, however the product must be in a re-saleable condition (undamaged and in original packaging) and must have all labels still attached.
(Returns will only be accepted for the following reasons.)
Item Received Damaged or Defective
If you receive goods that have been damaged in transit, or are defective, please contact us immediately. You will be given a Returns Number and we will arrange for collection. A replacement will be despatched as soon as possible.
If, on return, the item is found not to be damaged, nor defective, we reserve the right to charge a £15 processing fee, plus shipping fees, before the cable is released to be returned. (Should the customer refuse to pay these fees within 28 days, then a refund will be issued minus the £15 processing fee and the shipping fees incurred.) If the customer requests a refund once the item is returned, the return shipping fees will become liable and will be deducted from the refund.
Incomplete Orders
If your order is incomplete, and we have not notified you of this beforehand, contact us immediately explaining what the shortage is. We can then seek to resolve the issue promptly and to your satisfaction.
Incorrect Item Received
If you have received a different item from the one that you ordered contact us straight away. You will be given a Returns Number and we will arrange for the item to be collected and get the correct item to you as soon as possible.
If, after receiving the item, you discover that you have ordered incorrectly please contact us immediately. You will be given a Returns Number to return the item to us at your own expense. Once the item has been received by our returns dept. it will be inspected. So long as the item has been unused and is in its’ original packaging we will then send out a replacement. The cost of returning the item to us and sending out a replacement will be the responsibility of the customer. (The amount of £12.50 will be charged to send the replacement to you. If you want us to arrange collection and replacement the charge will be £25.00 - Overseas customers must contact us for prices.)
All returns must be in or with their original packaging and you must quote the returns number.
Your statutory rights are not affected.
For non-UK returns please call us on +441530835859 and we will try to help as best we can. Unfortunately, we do not hold any agreement with local couriers so any returns will be at your own expense.

SECTION 22 - ADDITIONAL TERMS & CONDITIONS FOR TRADE ACCOUNTS
Applications for a Trade Account will be accepted at Powerpac Ltd.’s sole discretion. Powerpac Ltd reserve the right to refuse any Trade Account application for any reason whatsoever.
All Trade Account holders may have their discount rate increased, or decreased, dependent on ordering levels. We will notify the account holder by their contact email and the adjustment will take place within 24 hours. All adjustments will apply the next time the discount code is used. The decision to increase or decrease your discount is at the sole discretion of Powerpac Ltd. and an adjustment may be withheld for any reason deemed appropriate. Returns and refunds will be taken into account when calculating your order level.
A Trade Account discount code is issued to the company making the application and is non-transferable. If Powerpac Ltd. believe that a code has been transferred the account will be suspended without prior notice. (You will be notified by email to the contact email given, of the decision, once it has been made.)
As a Trade Account holder, you will receive a minimum discount of 5% on all products purchased from our online store located at www.powerp.co.uk. It does not include sale and discounted prices. It does not include sales made outside of our online store, e.g. eBay or Amazon.
We reserve the right to withdraw any Trade Account or discount code at any time without prior notice. (You will be notified by email to the contact email given, of the decision, once it has been made.)
We, also, reserve the right to withdraw the whole Trade Account Scheme at any time without prior notice. (You will be notified by email to the contact email given, of the decision, once it has been made.)
Our liability
Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession)
- Defective products under the Consumer Protection Act 1987.
If you are acting in the course of a business, trade or profession (a business user) we shall:
- Under no circumstances whatever be liable to compensate you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Contract. For the avoidance of doubt, we shall have no liability to compensate you in relation to your use of the Website or its content whether arising in tort (including negligence), contract, for breach of statutory duty or otherwise, except for any refund we make under any other agreement between us or otherwise at our discretion.
- Without prejudice, if you are acting as a business customer in your ordering and/or purchasing of Products, we accept no liability (whether arising in contract, tort (including negligence), for breach of statutory duty or otherwise) for any of the following losses:
- Loss of profits, revenue, sales, income, or business
- Loss of savings
- Loss of use or production
- Loss of goodwill
- Business interruption
- Remedial costs if the Products are damaged or defective
- Damage to property or possessions through use or misuse of the products
- Loss caused by delay or other late performance
- Indirect or consequential losses
- Our total liability to you in respect of any other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the products you have purchased.
